Sharecycle Members’ Agreement and Items Policy
1.Members must be age 18 or over to borrow items from Sharecycle.
2.Only Members of the Sharecycle are eligible to borrow items. Prior to borrowing items, all Members must (a) complete a Membership Application Form; (b) agree the Liability Waiver and Indemnification Form;(c) have their residence confirmed by a Sharecycle volunteer or member of the staff; and(d) Make a donation towards their annual membership.
3.Items have a fee for borrowing, which refers to a week-long loan, and must be paid prior to borrowing things from Sharecycle Borrowing fees pay for items maintenance, replacement parts, new tools and upkeep of Sharecycle’ s facilities.
4.The Sharecycle staff is available to assist in explaining operation of items and can provide any available manuals upon request. However, by taking possession of any item, the Member warrants and represents to Sharecycle that they(a) have no mental or physical incapacity that would affect their ability to use the item safely , (b) is capable of using the item in a safe and proper manner.
5.Only the Member is authorized to use Sharecycle’ s items. The Member shall not permit the use of items checked out to them by any other person unless by the express permission of the Sharecyle.
6.Reservations should be made online, in person or in writing and if the Member changes their mind, they should give Sharecycle at least 48h notice in order to receive a full refund.
7.All items will be lent for a period that works on a weekly basis and are to be returned to Sharecycle on or before their return date deadline. Items may only be returned during Sharecycle’s opening hours. Late fines will be levied for each item kept past the loan period. All fines and fees must be paid in full before Members can borrow additional items.
8.All items are to be returned in the same (or better) condition as they were issued, barring normal wear and tear. All items must be returned clean.
9.The Member agrees to pay for the loss of or any item. The Member further agrees to accept Sharecycle’s staff’s assessment of the condition of returned items and staff’s assessment of fair restitution for damage, delinquency and/or loss of items in part or in total.
10.Members may renew each item for a second period if (a) the Member contacts the Sharecycle by the day the item is due to be returned, and (b) no other Member has reserved the item. In an effort to maximize availability of items, Sharecycle reserves the right to refuse or limit renewals.
11.The Member agrees that Sharecycle is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed items. Each time you take an item out, you must check it visually before you take it, and make other checks for any faults that you may be able to identify before using it. The Member agrees that if any borrowed item becomes unsafe or in a state of disrepair, they must immediately discontinue use of the item and notify Sharecycle on return. Sharecycle will only be liable to you for damage caused by our negligence in failing to tell you about a known fault. We will not be liable for faults of which we are not aware of.
12.When borrowing electrical equipment, the Member must check the visible wires and plug for any damage before use. The Member must take ALL necessary precautions when using the borrowed item. Personal Protective Equipment should be worn where appropriate, including but not limited to, eye protection, ear protection, gloves, appropriate footwear, etc.
13.If one Member borrows an item and with the Sharecycle's agreement pass it on to another Borrower before it is returned to Sharecycle and booked in, the first Member remains liable to the Sharecycle for the return and condition of the object until it is returned to the Sharecycle. If a member collects an item from another Borrower with Sharecycle’s agreement, that loan will also be on the terms of this Agreement.
14.The Member understands and accepts that in an effort to maximize availability of items to all Members, Sharecyle sends emails as a reminder when borrowed items’ return dates are approaching. When items are not returned by the designated due date, Sharecycle will issue an overdue notice by phone call, email, or letter. If the items are not returned after the notice has been sent, appropriate steps will be taken to retrieve them, including the use of a collection agency and/or legal action. Fines must be paid in full before borrowing additional items.
15.The Sharecycle reserves the right to limit the number of items borrowed, refuse the loan of any item or request for membership at the staff’s discretion. We reserve the right to change these terms and conditions at any time, and you agree to abide by the most recent version of this Terms of Use Agreement each time you borrow from Sharecycle.
16.The signing Member affirms that the information provided on the Membership Application is current, true, and correct. The Member understands that this information may be subject to verification.
17.The signing Member further states that they have read and fully understand the rules and regulations of Sharecycle, and they understand that failure to comply with any of these rules may result in revocation of their borrowing privileges and/or legal action against them. The signing Member has read and signed a Waiver and Indemnification Form, relinquishing any and all claims against Sharecycle.
Liability Waiver and Indemnification Form
The items in our collection are for the use of Sharecycle members. Out of respect for future users, please take care of the items you borrow and report any damage to the Sharecycle team immediately. Though Members are responsible for damage that they have caused, we promise you will be treated with respect. If you feel compelled to return the items in better condition than when you borrowed them, that would be highly appreciated!
Your Statements –READ THIS CAREFULLY EVERY TIME YOU BORROW ANYTHING
I am capable and experienced in using the items I am borrowing. I will use the items I am borrowing in a safe and proper manner. I am aware that Sharecycle, its partners, directors, officers, members, volunteers and employees claim no expertise and make no representation concerning the fitness of any item for any particular use.
I, do hereby for myself, on behalf of my heirs, successors, and assigns, in consideration of being permitted to borrow various items, waive any and all claims against Sharecycle, its officers, agents, volunteers and employees for any injury or injuries of any nature that I may suffer or incur in the use of the item that I am borrowing from Sharecycle except those caused by a defect known to Sharecycle and not made known to me.
I agree to release and indemnify and hold harmless Sharecycle, its officers, agents, volunteers and employees from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use or possession of items I am borrowing from Sharecycle.
I have read and fully understand and agree to the Sharecycle’s Members’ Agreement and Items Policy, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me. I affirm that the information that I have provided on the Membership Application Form is current, true, and correct. I understand that this information may be subject to verification.
Boro Bricks Terms and Conditions
1. General
1.1. This Agreement is made between Boro Bricks and the member of Boro Bricks.
1.2. Members must be age 18 or over to rent items from Boro Bricks. Boro Bricks will be referred to as ‘’BB ‘’ and members ‘’you’’ or ‘’your’’ for the purposes of this Agreement.
1.3. These terms will apply to all members of the BB service.
1.4. BB acknowledges that LEGO:registered: is a trademark of the LEGO Group of companies. BB is not endorsed, affiliated or sponsored by LEGO:registered:. All LEGO:registered: sets belonging to BB have been legally purchased or donated by private or named persons. They are fully owned by BB.
1.5. Only Members of BB are eligible to borrow LEGO:registered: sets. Prior to borrowing LEGO:registered: sets Members must i) complete a Membership Application Form ii) agree the Liability waiver and Indemnification form iii) have their residence confirmed by a Boro Bricks staff member and iv) make a donation towards their annual membership.
1.6. BB may terminate or suspend Your access to our Service immediately for any reason whatsoever, including if you are found to have breached these Terms.
2. Loan and Return of LEGO:registered: sets.
2.1. Upon payment of a rental fee and a refundable deposit BB agrees to loan You the LEGO:registered: set selected by You from our Boro Bricks LEGO:registered: inventory, in accordance with these terms and conditions.
2.2. The LEGO:registered: set(s) must be collected by You at pre-arranged specified date from the Boro Exchange.
2.3. The LEGO:registered: set(s) must be returned to the Boro Exchange by the date specified on the LEGO:registered: loan record. If You wish to extend the loan period, you must contact BB in advance for permission. Permitted loan extensions will be charged at half the rental fee for loaned LEGO:registered: set.
2.4. Only You, the Member, is authorised to loan BBs LEGO:registered: sets. Members of Your household who are habitually resident in Your house may use the sets. You are not authorised to loan LEGO:registered: sets out for members of other households unless with express permission of BB.
2.5. After returning the LEGO:registered: sets to BB, BB will refund Your refundable deposit paid at the start of the loan period. Refunds are subject to the LEGO:registered: sets being returned in a satisfactory condition.
2.6. Failing to return the LEGO:registered: sets by the agreed date will result in the deposit being withheld and You will be charged the full replacement cost of the set.
2.7. Only one large LEGO:registered: set may be borrowed by a Member at a time or two small sets. Large is defined as a LEGO:registered: set with a RRP in excess of £100.
3. Your responsibilities
3.1. Upon receipt of the LEGO:registered: sets, you will look after it appropriately and handle it with care.
3.2. You are responsible for looking after the LEGO:registered: sets loaned to you by BB and making sure they’re returned to BB in the same condition as you received them.
3.3. You will be charged for lost or damaged LEGO:registered: pieces. Examples of damage include significant scratching, bite marks, distortions, breaks and cracks.
3.4. BB will not charge for the replacement of generic missing pieces if the total value of the missing pieces does not exceed £1. If the missing piece(s) is unique to the set the Member must pay the entire cost to replace the missing piece. Charges to replace missing/damaged pieces do not represent the purchase of a LEGO:registered: set by the customer.
3.5. You accept full responsibility for any loss or damage to LEGO:registered: sets You have loaned from BB. If the set is lost, stolen or damaged it is Your responsibility to reimburse BB with the full cost to replace the set.
3.6. If one Members borrows a LEGO:registered: set and with BB’s agreement passes it on to another BB Member before it is returned to BB and booked in, the first Member remains liable to BB for the return and condition of the set until it is returned to BB. If a Member collects a LEGO:registered: set from another Member with BB’s agreement, that loan will also be on the terms of this Agreement.
3.7. The Member understands and accepts that in an effort to maximize availability of items to all Members, BB will send emails as a reminder when borrowed LEGO:registered: sets return dates are approaching. When LEGO:registered: sets are not returned by the designated due date, BB will issue an overdue notice by phone call, email or letter. If the LEGO:registered: sets are not returned after the notice has been sent, appropriate steps will be taken to retrieve them, including the use of a collection agency and/or legal action. Late fees must be paid in full before borrowing further LEGO:registered: sets.
4. Liability Waiver and Indemnification Form
The LEGO:registered: sets in our collection are for the use of BB members. Out of respect for future users, please take care of the sets you borrow and report any loss or damage to the BB team immediately.
4.1 Your Statements – Read this carefully before borrowing a LEGO:registered: set.
4.2. I will use the sets in a safe and proper manner. I am aware that BB, its partners, directors, officers, members, volunteers and employees claim no expertise and make no representation concerning the fitness of any LEGO:registered: set for my use.
4.3. I, do hereby for myself, on behalf of my heirs, successors, and assigns, in consideration of being permitted to borrow LEGO:registered: set , waive any and all claims against BB, its officers, agents, volunteers and employees for any injury or injuries of any nature that I may suffer or incur in the use of the LEGO:registered: set that I am borrowing from BB except those caused by a defect known to BB and not made known to me.
4.4. 4.5. I have read and fully understand and agree to the BB’s Members’ Agreement and Items Policy, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me.
4.6. I affirm that the information that I have provided on the Membership Application Form is current, true, and correct. I understand that this information may be subject to verification.
5. Data Protection
5.1. All information and supporting documentation supplied by You as part of the membership process will be used for the sole purpose of providing LEGO:registered: sets to borrow. Your LEGO:registered: Loan record and any related information will be held and maintained in accordance with the provisions of Data Protection Legislation. The data will not be passed to any other third party without your consent, except when BB is required to do so by law.
6. Changes to Terms and Conditions
6.1. These terms and conditions may be revised and changed at any time. The Member will be informed of any changes as and when they occur.
6.2. BB reserves the right to modify these terms and conditions at any time. Where revisions result in a change in terms of rental, we will provide The Member with 30 days’ notice before the changes come in effect.
6.3. If you do not agree with the new terms and conditions you must stop using the service. Continuing to use the BB LEGO:registered: loan service after the changes have come into effect will be taken as agreement with the new terms and conditions.
